Policy Acknowledgement

By purchasing, installing, or using Motorcycle Drop Guards, referred to below as the “Product,” the purchaser, user, motorcycle operator, rider, or passenger, referred to below as the “User,” acknowledges and agrees to these Terms and Conditions.

The User also acknowledges and agrees to the following policies and information:

  • The Motorcycle Drop Guards Refund Policy
  • Installation instructions and guidance
  • The Media Rights Agreement and Waiver
  • Product Safety and Use Warnings
  • Product-specific fitment information

By checking an agreement box during the ordering or checkout process, the customer confirms that they have read, understood, and agreed to these terms.

General Terms

1. Assumption of Risk and Waiver of Liability

The User acknowledges and accepts that operating, handling, lifting, or working around a motorcycle is inherently dangerous.

The User voluntarily assumes all associated risks, including the risk of serious injury, death, motorcycle damage, property damage, or financial loss.

These risks remain present regardless of the User’s experience level, operating speed, riding surface, training environment, or use of Motorcycle Drop Guards.

Motorcycle Drop Guards are intended to help minimize cosmetic or structural damage to certain factory-attached motorcycle components during low-speed maneuvers under approximately 1,200 RPM in controlled environments such as training courses, parking lots, or garages.

Although some users may choose to leave the Product installed during street use, the Product is not designed, marketed, tested, certified, or warranted to protect against damage or injury during street riding, higher-speed operation, aggressive cornering, public-roadway use, or a collision.

Any use outside the Product’s intended purpose is undertaken entirely at the User’s own risk.

By purchasing, installing, or using the Product, the User assumes responsibility for injuries, damages, losses, and consequences arising from the use or misuse of the Product.

2. Product Use Disclaimer

The Product is intended primarily for controlled, low-speed environments where tip-overs and slow-moving drops are most likely to occur.

By using the Product, the User acknowledges and agrees that:

  • The Product may affect lean angle, handling, and ground clearance.
  • Surface conditions, tires, suspension, highway pegs, accessories, motorcycle loading, and modifications may affect clearance.
  • The Product may interfere with the ground during regular or aggressive street riding.
  • The Product is not compatible with motorcycles that have been lowered from their original OEM ride height.
  • The User is responsible for confirming correct fitment and installation before using the motorcycle.
  • The User assumes responsibility for injury, damage, or mechanical issues resulting from use outside the Product’s intended purpose.

3. Release and Waiver of Liability

To the fullest extent allowed by law, the User releases and holds harmless Calley Motorcycle Parts, LLC, doing business as MDG Products, including its officers, employees, agents, affiliates, successors, and assigns, collectively referred to as the “Released Parties,” from liability arising from:

  • Injury or death
  • Motorcycle or property damage
  • Installation, removal, use, or misuse of the Product
  • Improper fitment or installation
  • Use of the Product outside its intended purpose

This waiver applies to claims of ordinary negligence to the extent permitted by law. It does not apply to gross negligence, intentional misconduct, or other claims that cannot legally be waived.

4. Indemnification

The User agrees to indemnify, defend, and hold harmless the Released Parties from claims, liabilities, damages, expenses, attorneys’ fees, and losses arising from or relating to:

  • Use or misuse of the Product
  • Improper installation, modification, or removal
  • Operation of a motorcycle with the Product installed
  • Participation in or presence at an event involving the Product
  • Violation of applicable laws or regulations
  • Third-party claims arising from any of the above activities

5. Acknowledgement of Instructions and Warnings

The User confirms that they have reviewed and understood the product description, fitment information, installation instructions, FAQs, warnings, and policies available on the Motorcycle Drop Guards website.

The User agrees to follow all product-specific instructions and warnings.

Failure to follow the instructions may increase the risk of personal injury, motorcycle damage, product damage, or product failure.

6. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of Texas.

Any dispute shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and the User consents to the jurisdiction of those courts.

7. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

An invalid or unenforceable provision will be interpreted or limited to the extent necessary to best reflect the original intent while complying with applicable law.

By checking an agreement box, placing an order, installing the Product, or using the Product, the User confirms that they have read, understood, and voluntarily agreed to:

  • These Terms and Conditions
  • The assumption of risks associated with motorcycle operation and use of the Product
  • The limitations of the Product’s use and scope of protection
  • The applicable liability and indemnification provisions
  • The Refund Policy
  • The installation instructions and warnings
  • The Media Rights Agreement and Waiver
  • The Product Safety and Use Warnings

The User accepts responsibility for risks, damages, and consequences arising from the purchase, installation, use, or misuse of the Product.

Refunds, Cancellations, Returns, and Shipping

Motorcycle Drop Guards are custom-made specialty products. Except for the limited provisions stated in the Refund Policy, all sales are final.

The Motorcycle Drop Guards Refund Policy governs:

  • Order cancellations
  • Returns and replacements
  • Damaged deliveries
  • Return authorization
  • Inspection, restocking, and refurbishing fees
  • Lost, stolen, or delayed shipments
  • Chargebacks and payment disputes
  • International shipping, customs, duties, and returned shipments

By placing an order, the customer confirms that they have reviewed and agreed to the current Refund Policy.

Installation Guidance

Compatibility and Fitment

Motorcycle Drop Guards are engineered only for compatible motorcycle models and OEM bar configurations identified in the applicable product description and fitment information.

The User is responsible for confirming motorcycle model, year, ride height, bar diameter, bar curvature, and hardware requirements before ordering or installing the Product.

Unless the applicable product description states otherwise:

  • Compatible front highway or engine bars must be 1.25 inches in diameter and have the required curvature.
  • Compatible rear saddlebag bars must be 7/8 inch in diameter and have the required curvature.
  • The motorcycle must remain at its original OEM ride height.
  • The Product must not be forced onto an incompatible bar or mounting location.

Fitment requirements may vary between Harley-Davidson, Indian Motorcycle, and other motorcycle configurations. The applicable product page and fitment guide control.

Installation Responsibility

The customer and installer are responsible for proper installation.

Improper installation may cause:

  • Structural or component interference
  • Reduced ground clearance
  • Broken, damaged, or stripped fasteners
  • Damage to OEM motorcycle components
  • Incorrect Product alignment
  • Failure of the Product to perform as intended during a drop

Do not continue installation when the Product does not fit easily or align with the intended mounting location.

Always follow the current official installation instructions for the applicable motorcycle and Product.

Using incorrect parts, substituting hardware, over-tightening fasteners, failing to follow instructions, or installing the Product in an incorrect position may affect safety, damage the motorcycle, damage the Product, or prevent the Product from performing as intended.

After installation, carefully confirm that the Product is positioned correctly and that the intended contact areas engage as described in the installation instructions.

Media Rights Agreement and Waiver

By voluntarily submitting, sharing, or publicly posting photographs, videos, testimonials, or other media featuring Motorcycle Drop Guards, the participant agrees to the following terms.

Grant of Rights

The participant grants MDG Products, its successors, licensees, affiliates, and assigns a worldwide, royalty-free, perpetual right to use, reproduce, distribute, display, publish, edit, crop, resize, and otherwise adapt submitted or publicly shared media that includes:

  • The participant as a rider, operator, passenger, customer, instructor, affiliate, or promoter
  • A motorcycle equipped with Motorcycle Drop Guards
  • The installation, demonstration, promotion, or use of Motorcycle Drop Guards

This permission includes lawful use in advertising, marketing, social media, websites, email, printed materials, commercial communications, and other formats currently known or developed in the future.

Source of Media

This grant applies to:

  • Media voluntarily sent or submitted to MDG Products
  • Media voluntarily posted or shared by the participant on a public platform
  • Media captured by MDG Products or its representatives with the participant’s knowledge or participation
  • Media submitted in connection with an affiliate, promotional, training, or customer program

Waiver of Compensation and Approval Rights

Unless a separate written agreement states otherwise, the participant waives the right to:

  • Receive compensation or royalties for authorized use of the media
  • Inspect or approve the final use, layout, copy, or presentation
  • Assert a claim arising solely from an authorized use of the media

Acknowledgement of Consideration

The participant’s purchase, voluntary submission of media, promotion of the Product, or participation in an affiliate, customer, or training program constitutes consideration for this agreement.

Jurisdiction and Governing Law

This Media Rights Agreement and Waiver is governed by the laws of the State of Texas.

Any dispute shall be subject to the exclusive jurisdiction of the state or federal courts located in Harris County, Texas.

By voluntarily submitting, sharing, or participating in the creation of applicable media, the participant confirms that:

  • They have read and understood this Media Rights Agreement and Waiver.
  • They have the authority to grant the rights described above.
  • They agree to be bound by these terms.

Product Safety and Use Warnings

Intended Use

The Product is designed primarily for controlled, low-speed environments such as parking lots, motorcycle training courses, garages, and similar settings.

It is not intended to protect the motorcycle or rider during high-speed street riding, collisions, competitive events, aggressive cornering, or maneuvers involving extreme lean angles.

While some users choose to leave the Drop Guards installed at all times, the Product’s primary purpose is to help reduce damage to certain mounting components during controlled tip-overs and slow-moving drops under approximately 1,200 RPM.

No product can prevent all motorcycle damage or personal injury.

Lean Angle and Confined Turns

Motorcycle lean angle and clearance are affected by surface conditions, tire size, tire pressure, suspension, motorcycle loading, highway pegs, accessories, bar position, and other modifications.

The Product may contact the ground or interfere with turns tighter than approximately 18 feet.

Users should remove all applicable guards, including the Primary Guard, Front Guards, and Rear Guards, before performing tight or confined-space maneuvers or before street riding.

Failure to remove the Product before these activities is at the User’s own risk.

Use on Lowered Motorcycles

The Product is not compatible with motorcycles that have been lowered from their original OEM ride height.

Installing or using the Product on a lowered motorcycle increases the risk of ground contact, interference, loss of clearance, damage, or malfunction.

Use on a lowered motorcycle is outside the Product’s intended fitment and is undertaken at the User’s own risk.

Scope of Protection

The Product is intended to help reduce minor cosmetic or structural damage during certain low-speed tip-overs to the factory components where the Product is properly attached, including applicable:

  • Front highway or engine bars
  • Rear saddlebag protection bars
  • Harley-Davidson primary covers when the applicable Primary Guard is correctly installed

The Product is not designed or warranted to protect:

  • Lower fairings
  • Brake or clutch levers
  • Handlebars or mirrors
  • Stretched or aftermarket saddlebags
  • Parts not directly connected to the Product’s mounting points
  • Riders, passengers, bystanders, or third parties
  • The motorcycle during a collision or higher-speed drop

The Product may incidentally help keep nearby components farther from the ground, but protection of those components is not guaranteed.

Primary Guard Use

The Primary Guard is intended for compatible Harley-Davidson Touring motorcycles from model year 2016 and newer.

The Primary Guard is not required for applicable Harley-Davidson models manufactured before 2016 and is not intended for Indian motorcycles.

When included with a Harley-Davidson full kit, the Primary Guard must be used only with properly installed Front and Rear Drop Guards.

The Primary Guard is not intended to function independently or with unrelated aftermarket protection products.

Do not install or use the Primary Guard on a motorcycle that has been lowered from its original OEM ride height.

Fastener and Maintenance Checks

Before every ride and after every motorcycle drop, inspect:

  • Guard fasteners
  • Fastener tightness
  • Guard alignment and positioning
  • Mounting surfaces
  • Gaskets and protective contact surfaces
  • Fasteners and guards for bending, cracking, stripping, or other damage

Vibration, repeated handling, and motorcycle drops may loosen or shift the Product.

Regular inspection and tightening are required, similar to routine tire, fluid, and motorcycle safety checks.

MDG Products recommends careful hand-tightening with the correct tools. Over-tightening may damage fasteners or motorcycle components. The use of threadlocker is at the customer’s discretion unless the applicable installation instructions state otherwise.

Do not operate the motorcycle with a loose, misaligned, or damaged guard.

Weight, Risk, and Rider Responsibility

Motorcycles may weigh between approximately 300 and 1,000 pounds and can create serious injury risks during riding, lifting, handling, or training.

Riders should:

  • Receive professional instruction in low-speed motorcycle control.
  • Practice in a suitable controlled environment.
  • Practice under appropriate supervision when possible.
  • Use proper motorcycle lifting techniques after a drop.
  • Inspect the motorcycle and Product after every drop.
  • Stop using the Product when uncertain about its fitment, condition, safety, or effect on motorcycle handling.

The Product is not a substitute for motorcycle training, proper riding techniques, protective equipment, maintenance, or reasonable judgment.
